1. PROMENE U USLOVIMA KORIŠĆENJA
DAIRE zadržava pravo promene uslova korišćenja zavisno od promene u ponudi svojih usluga i(li) važeće zakonske regulative. Kupac je u obavezi da pre svake kupovine proveri informacije vezane za uslove poslovanja. Korišćenjem sajta, kupac je saglasan sa uslovima korišćenja i kupovine, što potvrđuje kupovinom.
2. KUPOVINA
Sva naručena roba putem web prodavnice Prodavca obavezujuća je za Kupca i Prodavca istovremeno, i ne može biti otkazana ili izmenjena bez prethodnog dogovora obe strane.
Kupac se obavezuje da će tokom naručivanja robe preko web prodavnice Prodavca pratiti sledeće korake:
- Izbor artikla
- Izbor odgovarajuće varijacije (veličine, boje i sl.) artikla
- Izbor količine
- Prijava ili upisivanje ličnih podataka
- Pregled svih podataka, kontrola i prihvatanje porudžbine i Opštih uslova korišćenja i kupovine
- Zaključenje porudžbine
- Plaćanje putem izabranog metoda plaćanja
- Preuzimanje robe
3, NAČIN PLAĆANJA
Plaćanje na websajtu www.daireworld.com može se izvršiti pouzećem (samo za kupce u Srbiji), i preko platne kartice u saradnji sa OTP bankom. Potrebno je da posedujete Visa, Dina, MasterCard, ili Maestro platnu karticu odobrenu od strane banke izdavaoca za online plaćanje.
Nakon što potvrdite narudžbenicu, bićete preusmereni na sajt banke gde vršite unos podataka sa platne kartice i obavljate plaćate. Ukoliko je transakcija uspešna bićete vraćeni na naš sajt sa obaveštenjem da je plaćanje uspešno obavljeno.
U slučaju da plaćanje nije uspelo, bićete vraćeni na naš sajt sa informacijom o neuspelom plaćanju i moći ćete da ponovite plaćanje.
Za plaćanje pouzećem troškovi dostave biće uvećani za naknadu prenosa otkupne pošiljke i prenosa novca.
Za plaćanje karticama i nalogom za uplatu, gore navedeni trošak se ne obračunava.

Kod plaćanja platnim karticama – iz sigurnosnih razloga, podaci o vašoj platnoj kartici su vidljivi samo banci kao procesoru kartica. Sajt banke je zaštićen i siguran za ovaj način plaćanja.
Sva plaćanja biće izvršena u lokalnoj valuti Republike Srbije – dinar (RSD). Za informativni prikaz cena u drugim valutama koristi se kurs Narodne Banke Srbije na dan plaćanja. Iznos za koji će biti zadužena Vaša platna kartica biće izražen u Vašoj lokalnoj valuti kroz konverziju u istu po kursu koji koriste kartičarske organizacije/Vaša banka izdavalac, a koji nama u trenutku transakcije ne može biti poznat.
Kao rezultat ove konverzije postoji mogućnost neznatne razlike od originalne cene navedene na našem sajtu i one koju možete videti na vašem bankovnom izvodu.
4. OBAVEŠTENJA
Prodavac ima obavezu da po prijemu porudžbine pošalje email Kupcu sa potvrdom porudžbine, koja sadrži naziv, cenu i količinu poručenih artikala, ukupan iznos za uplatu, izabrani način plaćanja i dostave, kao i podatke o adresama koje je Kupac uneo za dostavu pordužbine.
5. SLANJE PORUDŽBINE
Prodavac se obavezuje da će robu poslati Kupcu u roku od 20 radnih dana, računajući od dana porudžbine u slučaju plaćanja pouzećem, tj. od dana prijema uplate u slučaju plaćanja na račun Prodavca, i metodom dostave koju je odabrao Kupac. U slučaju nemogućnosti slanja robe, Prodavac je dužan da Kupca obavesti u roku ne dužem od 5 radnih dana, računajući od dana porudžbine.
S obzirom da svaka zemlja definiše Zakone o prometu roba i usluga, može se dogoditi da NEZAVISNO OD NAS neke službe obračunaju dodatne troškove na našu robu i usluge, (troškove poštarine, otvaranja i kontrole paketa, carine, ponovne dostave, promene adrese dostave i slično).Preporuka je da se pre poručivanja robe proveri da li postoje posebne zabrane za zemlju iz koje se porudžbina obavlja. Sve troškove po navedenom, snosi kupac”
Prodavac ne može preuzeti odgovornost za bilo kakve nepredviđene troškove nastale zbog kašnjenja u dostavi i preuzimanju naručene robe od strane Kupca.
Kupac ima obavezu da Prodavcu dostavi tačne podatke za račun i isporuku robe (ime i prezime, puna adresa za dostavu, veličina, model i količina artikla). Ukoliko Kupac navede pogrešne lične podatke ili email adresu u procesu kupovine, Prodavac ne može snositi odgovornost za probleme u dostavljanju ili preuzimanju naručene robe.
Prilikom preuzimanja robe, Kupac je dužan da proveri kvalitet i stanje dostavljene robe.
Ukoliko na paketu ima vidnih oštećenja u obliku pocepanih delova ili nagnječenja, Kupac je dužan da zahteva otvaranje paketa u prisustvu službenog lica. Ako se tom prilikom ustanovi da su artikli oštećeni, zahteva se da se napravi zapisnik o reklamaciji.
Sve eventualne reklamacije biće rešavane u skladu sa Uslovima za reklamacije i povraćaj robe.
Za sve sporove između Prodavca i Kupca koji ne mogu biti rešeni sporazumno i u duhu dobre poslovne saradnje nadležan je sud u Beogradu.
6. REKLAMACIJE I POVRAĆAJ
Ukoliko ste robu kupili u online prodavnici, prilikom preuzimanja pošiljke molimo Vas da u prisustvu kurira proverite svoj paket. Ukoliko na njemu ima vidljivih oštećenja (pocepani delovi i ugnječenje) paket ne bi trebalo da preuzmete.
Ukoliko ste primili pošiljku i nakon otvaranja kutije ustanovili da isporučena roba ne odgovara naručenoj ili podaci na računu nisu odgovarajući, molimo Vas da nas kontaktirate najkasnije u roku od 24h od trenutka prijema pošiljke.
Ukoliko se na kupljenom proizvodu pojave neusaglašenosti u smislu odredbi Zakona o zaštiti potrošača, molimo Vas da nas kontaktirate.
U najkraćem mogućem roku, a najkasnije u roku od 14 dana od dana prijema reklamacije pisanim putem ili elektronskim, odgovorićemo Vam na uloženu reklamaciju i obavestićemo Vas o daljem postupanju. Rok za rešavanje reklamacije je 30 Dana od trenutka podnošenja iste.
U slučaju vraćanja robe kupcu koji je prethodno robu platio kuriru tj. pouzećem, troškove vraćanja robe ne snosi DAIRE, već trošak pada na teret kupca.
U slučaju vraćanja robe i povraćaja sredstava kupcu koji je prethodno platio nekom od platnih kartica, delimično ili u celosti, a bez obzira na razlog vraćanja, DAIRE je u obavezi da povraćaj vrši isključivo preko VISA, Dina, MasterCard i Maestro metoda plaćanja, što znači da će institucija na zahtev prodavca obaviti povraćaj sredstava na račun korisnika kartice.
U slučaju vraćanja robe i povraćaja sredstava kupcu koji je prethodno platio pouzećem, a bez obzira na razlog vraćanja, DAIRE je u obavezi da povraćaj vrši na tekući račun naveden od strane kupca.
Povraćaj sredstava će se izvršiti u roku od 14 dana od dana prijema robe.
Postupak rešavanja reklamacije sprovodi se na osnovu odredbi Zakona o zaštiti potrošača (“Sl.Glasnik RS” br. 62/2014) kao i odredbi Zakona o trgovini (“Sl.Glasnik RS” br. 53/10, 10/2013).
Na zamenu neispravnih proizvoda imate pravo ako je na proizvodu jasno vidljivo da greška nije nastala nepravilnim korišćenjem već da je došlo do greške u proizvodnji, pakovanju ili transportu. Rok za odgovor na reklamaciju je 8 dana od prijema reklamacije. Rok za rešavanje je 15 dana od prijema reklamacije.
Povrat robe se u tom slučaju vrši na naš trošak a prijava ide u jednostavna tri koraka:

– ime i prezime
– e-mail adresu
– broj porudzbine
2. Artikle namenjene za povrat adekvatno spakujte kako ne bi došlo do oštećenja u transportu.
3. Nakon što oštećena roba stigne u naše prostorije i provere opravdanost reklamacije, ispravan artikal biće isporučen na vašu adresu.
Ukoliko artikal više nemamo u ponudi, biće izvršen povraćaj novca. Zamena oštećenog artikla ide na trošak prodavca i vrši se preko odgovarajuće kurirske službe.
DAIRE zadržava pravo da ne primi nazad reklamirani proizvod ukoliko se pri pregledu ustanovi da je proizvod korišćen.

Napomena: prilikom predaje paketa kuriru obavezno preuzmite od kurira potvrdu da ste paket predali.
Trgovac ima pravo da odbije zahtev potrošača ukoliko utvrdi da roba nije u ispravnom stanju, usled neadekvatnog ili nepravilnog rukovanja (ostećena ili korišćenja). Roba se mora vratiti u originalnom pakovanju u kojem je stigla kod kupca.
U slučaju vraćanja robe i povraćaja sredstava kupcu koji je prethodno platio nekom od platnih kartica, delimično ili u celosti, a bez obzira na razlog vraćanja, DAIRE povraćaj vrši isključivo preko VISA, Dina, MasterCard i Maestro metoda plaćanja, što znači da će institucija na zahtev prodavca obaviti povraćaj sredstava na račun korisnika kartice.
U slučaju vraćanja robe i povraćaja sredstava kupcu koji je prethodno platio pouzećem, a bez obzira na razlog vraćanja, DAIRE je u obavezi da povraćaj vrši na tekući račun naveden u obrascu od strane kupca.
Povraćaj sredstava će se izvršiti u roku od 14 dana od dana prijema robe.
Podaci koje ostavite u ovom obrascu služe isključivo za evidentiranja izmena u prometu robe i DAIREWORLD DOO ih neće upotrebljavati u druge svrhe. Obrazac za odustajanje od ugovora u roku od 14 dana prilog je svake isporuke robe i potpisivanjem otpremnice o prijemu robe potrošač potpisuje da je primio isti, kao i robu u asortimanu i količini koju je naručio i koja mu je naplaćena navedenom otpremnicom.
Obaveza potrošača u slučaju odustanka od Ugovora regulisane su članom 35 ZAKONA O ZAŠTITI POTROŠAČA (sl.gl.62/14), tako da potrošač snosi isključivo direktne troškove za vraćanje robe, tj. da je odgovoran za umanjenje vrednosti robe koja nastane kao posledica rukovanja robe na način koji nije adekvatan, odnosno prevazilazi ono što je neophodno da bi se ustanovila priroda, karakteristike i funkcionalnost robe.

1. CHANGES TO THE TERMS OF USE
DAIRE reserves the right to change the terms of use depending on changes in its service offering and/or applicable legal regulations. The buyer is obliged to check the information related to the terms of business before each purchase. By using the site, the buyer agrees to the terms of use and purchase, which is confirmed by the purchase.
2. PURCHASE
All goods ordered through the Seller’s web store are binding on both the Buyer and the Seller simultaneously, and cannot be canceled or changed without prior agreement between both parties.
The Buyer undertakes to follow the following steps when ordering goods through the Seller’s web store:

Choosing the appropriate variation (size, color, etc.) of the item
Quantity selection
Login or enter personal data
Review of all data, control and acceptance of the order and General Terms and Conditions of Use and Purchase
Order completion
Payment via selected payment method
Taking over the goods
3, PAYMENT METHOD
Payment on the website www.daireworld.com can be made by cash on delivery (only for customers in Serbia), and by credit card in cooperation with OTP bank. You need to have a Visa, Dina, MasterCard, or Maestro credit card approved by the issuing bank for online payments.
After confirming your order, you will be redirected to the bank’s website where you enter your payment card details and make the payment. If the transaction is successful, you will be returned to our website with a notification that the payment was successful.
In case the payment is unsuccessful, you will be returned to our site with information about the failed payment and you will be able to repeat the payment.
For payment on delivery, delivery costs will be increased by the fee for transferring the purchase shipment and transferring money.
For payments by card and payment order, the above-mentioned cost is not charged.

When paying by credit card – for security reasons, your credit card information is visible only to the bank as the card processor. The bank’s website is protected and secure for this payment method.
All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). For informational display of prices in other currencies, the exchange rate of the National Bank of Serbia on the day of payment is used. The amount for which your payment card will be charged will be expressed in your local currency through conversion into the same at the exchange rate used by the card organizations/your issuing bank, which cannot be known to us at the time of the transaction.
As a result of this conversion, there is a possibility of a slight difference between the original price listed on our website and the one you can see on your bank statement.
4. NOTICES
The Seller is obliged to send an email to the Buyer with an order confirmation upon receipt of the order, which contains the name, price and quantity of the ordered items, the total amount to be paid, the selected payment and delivery method, as well as information about the addresses entered by the Buyer for delivery of the order.
5. SENDING AN ORDER
The Seller undertakes to send the goods to the Buyer within 20 working days, counting from the date of the order in case of payment by cash on delivery, i.e. from the date of receipt of payment in case of payment to the Seller’s account, and by the delivery method chosen by the Buyer. In case of impossibility of sending the goods, the Seller is obliged to notify the Buyer within a period not exceeding 5 working days, counting from the date of the order.
Since each country defines its own laws on the sale of goods and services, it may happen that INDEPENDENTLY OF US, some services may charge additional costs for our goods and services (postage costs, opening and checking packages, customs duties, re-delivery, change of delivery address, etc.). It is recommended that before ordering goods, check whether there are any special restrictions for the country from which the order is being placed. All costs according to the above are borne by the buyer.
The Seller cannot be held responsible for any unforeseen costs incurred due to delays in delivery and collection of the ordered goods by the Buyer.
The Buyer is obliged to provide the Seller with accurate information for the invoice and delivery of the goods (name and surname, full delivery address, size, model and quantity of the item). If the Buyer provides incorrect personal information or email address during the purchase process, the Seller cannot be held responsible for problems with the delivery or collection of the ordered goods.
When receiving the goods, the Buyer is obliged to check the quality and condition of the delivered goods.
If the package shows visible damage in the form of torn parts or bruises, the Buyer is obliged to request that the package be opened in the presence of an official. If it is determined that the items are damaged, a complaint report is required.
All possible complaints will be resolved in accordance with the Terms and Conditions for Complaints and Returns.
The court in Belgrade has jurisdiction over all disputes between the Seller and the Buyer that cannot be resolved amicably and in the spirit of good business cooperation.
6. COMPLAINTS AND RETURNS
If you purchased the goods in an online store , when you pick up the shipment, please check your package in the presence of the courier. If there is visible damage (torn parts and crushing), you should not pick up the package.
If you have received the shipment and after opening the box you find that the delivered goods do not match the ordered goods or the information on the invoice is incorrect, please contact us no later than 24 hours from the moment of receipt of the shipment.
If the purchased product is found to be non-compliant with the provisions of the Consumer Protection Act, please contact us.
As soon as possible, and no later than 14 days from the date of receipt of the complaint in writing or electronically, we will respond to your complaint and inform you of further action. The deadline for resolving the complaint is 30 days from the date of submission.
In the event of returning goods to a customer who previously paid for the goods to the courier, i.e. cash on delivery, the costs of returning the goods are not borne by DAIRE, but rather by the customer.
In the event of returning goods and refunding funds to a customer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the return, DAIRE is obliged to make the refund exclusively via VISA, Dina, MasterCard and Maestro payment methods, which means that the institution will, at the seller’s request, refund the funds to the cardholder’s account.
In the event of returning goods and refunding funds to a customer who previously paid by cash on delivery, regardless of the reason for the return, DAIRE is obliged to make the refund to the current account specified by the customer.
Refunds will be made within 14 days of receipt of the goods.
The complaint resolution procedure is carried out based on the provisions of the Consumer Protection Law (“Official Gazette of the Republic of Serbia” No. 62/2014) as well as the provisions of the Trade Law (“Official Gazette of the Republic of Serbia” No. 53/10, 10/2013).
You are entitled to a replacement for defective products if it is clearly visible on the product that the error was not caused by improper use, but rather by an error in production, packaging or transport. The deadline for responding to a complaint is 8 days from receipt of the complaint. The deadline for resolving the complaint is 15 days from receipt of the complaint.
In this case, the return of the goods is done at our expense and the application takes place in three simple steps:

– e-mail address
– order number
2. Pack items intended for return adequately to prevent damage in transit.
3. After the damaged goods arrive at our premises and we verify the validity of the complaint, the correct item will be delivered to your address.
If the item is no longer available, a refund will be issued. Replacement of the damaged item is at the seller’s expense and is carried out via the appropriate courier service.
DAIRE reserves the right not to accept the returned product if upon inspection it is determined that the product has been used.
7. RETURN OF GOODS (PURCHASES IN A STUDIO / PHYSICAL STORE)
In accordance with the Law on Consumer Protection of the Republic of Serbia, we inform customers that the return of purchased clothing and the refund of money are NOT made for goods purchased in the physical space (studio), if the goods are in accordance with the contract, that is:
• no damage,
• no manufacturing or hidden defects,
• corresponds to the description, purpose and declared characteristics.
The right to a refund or exchange of goods exists only in case of non-conformity of the goods, in accordance with Articles 50-54 of the Law on Consumer Protection, i.e. if it is determined that the goods:
• has a material or hidden defect,
• does not correspond to the agreed quality, size or description,
• has factory damage.
In that case, the consumer has the right to:
• repair,
• replacement,
• price reduction,
• or termination of the contract (refund), if the previous options are not possible.
The return of goods for reasons of personal preference (inappropriate model, style, color, size, personal impression, etc.) does not constitute a legal basis for refunding money when purchased in a physical space.
By purchasing goods in the studio, it is considered that the consumer is familiar with and agrees with these conditions.
8. WITHDRAWAL FROM THE CONTRACT
In case of withdrawal from the contract, the consumer has the right to a refund or exchange for another product within 14 days. The money will be returned to the buyer after the goods have been returned to the address for receiving the form.

Note : When handing over the package to the courier, be sure to receive confirmation from the courier that you have handed over the package.
The trader has the right to reject the consumer’s request if it determines that the goods are not in proper condition, due to inadequate or improper handling (damaged or used). The goods must be returned in the original packaging in which they arrived at the buyer.
In the case of returning goods and refunding funds to a customer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the return, DAIRE makes the refund exclusively via VISA, Dina, MasterCard and Maestro payment methods, which means that the institution will, at the seller’s request, refund the funds to the cardholder’s account.

Refunds will be made within 14 days of receipt of the goods.
The information you provide in this form is used exclusively for recording changes in the circulation of goods and will not be used by DAIREWORLD DOO for any other purpose. The 14-day withdrawal form is attached to each delivery of goods and by signing the delivery note, the consumer confirms that he has received the goods, as well as the goods in the assortment and quantity he ordered and for which he was charged with the aforementioned delivery note.
The consumer’s obligations in the event of withdrawal from the Contract are regulated by Article 35 of the CONSUMER PROTECTION LAW (Sl.gl.62/14), so that the consumer bears exclusively the direct costs of returning the goods, i.e. he is responsible for the reduction in the value of the goods that occurs as a result of handling the goods in a manner that is inadequate, i.e. exceeds what is necessary to establish the nature, characteristics and functionality of the goods.
